Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the Tahikie Hair website, online store, content, products, and related services (collectively, the “Services”). The Services are operated by TAHIKIE, doing business as “Tahikie Hair” (“Tahikie Hair,” “we,” “us,” or “our”).

Please read these Terms carefully. By visiting our website, creating an account, submitting an order, or otherwise using the Services, you agree to these Terms and to the policies incorporated into them by reference. If you do not agree, do not use the Services.

Our store is hosted by Shopify Inc., which provides the ecommerce platform that enables us to offer the Services to you.

1. Eligibility and permitted use

You must be at least the age of legal majority in your place of residence to place an order. If you permit a minor to use the Services under your supervision, you are responsible for that use to the extent allowed by law.

You may use the Services only for lawful, personal, and non-commercial purposes unless we have authorized another use in writing. You must not:

· use the Services or our products for an illegal, fraudulent, or unauthorized purpose;

· violate any applicable law or the rights of another person;

· introduce malware, malicious code, or other harmful technology;

· scrape, harvest, copy, or systematically collect content or personal information without authorization;

· circumvent security features or interfere with the operation of the Services;

· impersonate another person or submit false, misleading, or incomplete information; or

· use the Services to send spam, phishing messages, or other unsolicited communications.

We may suspend or terminate access when we reasonably believe these Terms have been violated.

2. Accounts and account security

If you create an account, you must provide accurate and current information. You are responsible for safeguarding your login credentials and for activity conducted through your account. Please notify us promptly at SERVICE@TAHIKIEHAIR.COM if you believe your account or payment information has been used without authorization.

We may refuse, suspend, or close an account where reasonably necessary to protect customers, prevent fraud, comply with law, or enforce these Terms.

3. Product information and natural variations

We make reasonable efforts to describe and display our products accurately. However, device screens, lighting, photography, styling, and production differences may affect how colors and textures appear. Human-hair products are made from natural materials and may have minor variations in shade, wave or curl pattern, strand characteristics, length, weight, density, lace tone, construction, or finish. Measurements may also vary within normal production tolerances. These ordinary variations are not necessarily defects, provided the product materially matches its description and applicable consumer law.

Product images may show hair that has been washed, conditioned, cut, layered, curled, straightened, colored, installed, or professionally styled. Accessories, styling, and the final appearance shown in photographs or videos are not included unless the product page expressly says otherwise. Results may vary depending on installation, maintenance, products used, climate, and individual styling.

Product descriptions, prices, colors, specifications, availability, and packaging may be corrected or updated at any time. If a material error affects an order you have already placed, we will contact you and provide an appropriate option, which may include confirming the corrected order or canceling it for a refund.

4. Hair care, installation, and safety

Please review the care and installation instructions supplied with the product or published on our website. Before altering, coloring, bleaching, chemically treating, cutting, or installing a hair product, inspect it carefully and, where appropriate, test a small concealed section first. Chemical processing, excessive heat, improper installation, unsuitable products, or inadequate maintenance may permanently change or damage the hair or lace.

Stop using any product that causes irritation or an unexpected reaction and seek appropriate professional advice if needed. Product information on our website is general information and is not medical or professional cosmetology advice. Unless required by law or expressly agreed by us in writing, we are not responsible for third-party salon, removal, reinstallation, styling, or related service costs.

5. Pricing, taxes, and promotions

Prices are shown in the currency displayed at checkout and may change without notice. The price applicable to an order is the price shown when the order is submitted, subject to correction of obvious errors. Taxes, shipping charges, duties, and other charges, where applicable, will be disclosed as required before payment.

Discount codes, gifts, bundles, flash sales, loyalty benefits, and other promotions may be subject to separate terms, eligibility requirements, dates, exclusions, minimum purchase amounts, or quantity limits. Unless stated otherwise, promotions cannot be combined, applied retroactively, exchanged for cash, or used after expiration. If an order is partially returned, any refund may be recalculated to reflect the promotion actually earned on the items kept, as explained in our Refund Policy and to the extent permitted by law.

If we mistakenly list a product or promotion at an obviously incorrect price, we may reject or cancel the affected order before acceptance or shipment. If payment has already been collected, we will issue a refund to the original payment method.

6. Orders and contract formation

Submitting an order is an offer to purchase. An order confirmation acknowledges receipt of your order but does not necessarily mean that we have accepted it. We accept an order when we send a shipment confirmation or otherwise expressly confirm acceptance. Separate items in one order may be accepted and shipped separately.

We may reasonably refuse, limit, place on hold, or cancel an order, including because of product unavailability, pricing or description errors, suspected fraud, payment authorization problems, sanctions or legal restrictions, unusually high quantities, suspected resale, or an inability to deliver to the address provided. We may request additional information to verify the purchaser, payment method, billing information, or delivery address. If we cancel an order after payment has been collected, we will refund the canceled amount to the original payment method, subject to applicable law and payment-provider processing times.

You are responsible for checking product selections, length, color, texture, lace type, cap size, quantity, delivery address, and contact details before submitting your order. Contact us promptly if you notice an error. We cannot guarantee that an order can be changed or canceled after processing has begun.

7. Payment

You authorize us and our payment providers to charge the payment method you select for the total shown at checkout. You represent that you are authorized to use that payment method and that the billing information you provide is accurate.

Installment or buy-now-pay-later services are offered by independent third-party providers and may be subject to their own eligibility rules, credit decisions, agreements, fees, and privacy practices. We do not control those decisions or terms.

If you believe a charge is incorrect or an order has a problem, please contact us promptly so we can investigate. Nothing in these Terms limits any lawful right you may have to dispute an unauthorized or incorrect charge.

8. Shipping, delivery, title, and risk

Processing and delivery estimates are provided in our Shipping Policy and at checkout where applicable. They are estimates unless expressly stated otherwise. Delivery may be affected by order verification, product preparation, carrier operations, customs, weather, holidays, public emergencies, or other circumstances outside our reasonable control.

If we learn that we cannot ship within the time stated, or within the time required by applicable law when no time is stated, we will provide any delay notice, cancellation option, or refund required by law.

You are responsible for providing a complete and deliverable address. Where available, please review tracking information promptly and contact us if a shipment appears delayed, damaged, missing, or misdelivered. Claims may require photographs, packaging, carrier records, identity or address confirmation, or other reasonable documentation.

Title and risk of loss transfer as provided by applicable law. No provision in these Terms transfers risk to you earlier than permitted by mandatory consumer-protection law. Customs duties, import taxes, brokerage fees, and local charges are your responsibility only where clearly disclosed or legally imposed on the recipient.

9. Returns, exchanges, and refunds

Returns, exchanges, cancellations, and refunds are governed by our Refund Policy, which forms part of these Terms. Please read that policy before purchasing.

Because hair products are personal-wear products, eligibility may depend on hygiene, safety, and condition requirements stated in the Refund Policy. Unless the product is defective, incorrect, or applicable law provides otherwise, products may be ineligible for return after they have been installed, worn, washed, brushed through extensively, cut, colored, bleached, chemically treated, altered, perfumed, exposed to smoke, or otherwise changed from their original condition; lace may also need to remain uncut and intact. All tags, ties, seals, packaging, gifts, and included accessories may need to be returned as specified in the Refund Policy.

These limitations do not exclude or restrict rights that cannot lawfully be waived, including remedies for goods that are defective, materially misdescribed, or otherwise nonconforming under applicable consumer law.

10. Intellectual property

The Services and their content—including the Tahikie Hair name and marks, product names, photographs, videos, graphics, text, designs, logos, software, page layouts, and compilations—are owned by or licensed to us and are protected by intellectual-property laws.

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial shopping purposes. You may not reproduce, modify, distribute, publish, sell, license, reverse engineer, create derivative works from, or commercially exploit any part of the Services without our prior written permission, except where applicable law allows otherwise.

11. Reviews, photographs, and other user content

If you submit a review, photograph, video, comment, suggestion, or other content (“User Content”), you retain any ownership rights you have. You grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, adapt, translate, publish, display, distribute, and otherwise use that User Content in connection with operating, improving, and marketing Tahikie Hair and the Services, in any media, for the duration of the applicable rights. Where required by law, we will seek any additional permission needed for advertising use.

You represent that you have the necessary rights and permissions to submit the User Content and that it is accurate, authentic, and not unlawful, misleading, defamatory, infringing, obscene, abusive, or harmful. Reviews must reflect genuine experiences. We do not require a positive review as a condition of receiving a discount, gift, or other incentive, and incentivized content must be disclosed where required.

We may moderate or remove User Content when we reasonably believe it violates these Terms, platform rules, or law. We will not suppress a review merely because it expresses a negative opinion about a genuine experience.

12. Third-party services and links

The Services may contain links to or integrations with payment providers, delivery carriers, social networks, review services, analytics providers, and other third parties. Third-party services are governed by their own terms and privacy practices. We are not responsible for a third party’s independent acts, content, availability, or policies, except to the extent responsibility cannot be excluded by law.

13. Privacy

Our collection, use, disclosure, and protection of personal information are described in our Privacy Policy. Any cookie notice or privacy-choice page displayed on our website also applies. Please review those materials before using the Services.

14. Email and text communications

We may send transactional communications about your account, orders, payments, returns, or customer-service requests. If you separately opt in to marketing emails or text messages, you may withdraw consent at any time using the unsubscribe link, replying with the stated opt-out keyword, or contacting us. Consent to marketing is not a condition of purchase. Message and data rates may apply to text messages. Marketing communications are subject to applicable law and any additional terms presented when you subscribe.

15. Optional tools and future features

We may provide access to optional third-party tools or introduce new website features. Unless we state otherwise, those features form part of the Services and are subject to these Terms. Third-party tools may be provided on an “as available” basis and may be governed by separate third-party terms.

16. Errors, interruptions, and changes to the Services

We may correct errors, update information, or modify, suspend, or discontinue all or part of the Services. We will honor accepted orders or provide legally required remedies when a change affects an existing transaction. We do not guarantee that the website will always be uninterrupted, secure, or error-free, but this does not limit obligations that cannot be excluded by law.

17. Disclaimer of warranties

To the fullest extent permitted by law, and except for any express warranty we provide, the Services and products are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, title, durability, and non-infringement to the extent those warranties may lawfully be disclaimed.

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, the exclusions apply only to the extent permitted by law. Nothing in these Terms excludes any statutory warranty, guarantee, or consumer right that cannot legally be excluded.

18. Limitation of liability

To the fullest extent permitted by law, Tahikie Hair and its owners, directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, and licensors will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, data, goodwill, or business opportunities, arising from or related to the Services or products.

To the fullest extent permitted by law, our aggregate liability arising from or relating to a product, order, or the Services will not exceed the amount you paid to us for the product or order giving rise to the claim.

These limitations do not apply to fraud, willful misconduct, gross negligence where it cannot be limited, death or personal injury caused by negligence where liability cannot be excluded, or any other liability or remedy that applicable law does not allow us to exclude or limit.

19. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Tahikie Hair and its affiliates, personnel, and service providers from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful misuse of the Services, your material breach of these Terms, or your infringement of another person’s rights. This provision does not require you to indemnify us for our own negligence, misconduct, or violation of law.

20. Events beyond reasonable control

We are not responsible for delay or failure caused by events beyond our reasonable control, such as natural disasters, severe weather, epidemics, war, civil unrest, government action, labor disputes, customs delays, transportation disruption, telecommunications failure, cyberattack, or supplier interruption. This section does not remove any cancellation, notice, refund, or other right you have under mandatory law.

21. Governing law and disputes

These Terms and any dispute arising from them are governed by the laws of Hong Kong SAR, without regard to conflict-of-laws principles. Any court proceeding must be brought in the courts located in XUCHANG, unless applicable consumer law permits or requires you to bring a claim elsewhere.

Before filing a formal claim, we encourage you to contact us at SERVICE@TAHIKIEHAIR.COM so we can attempt to resolve the issue. This informal step does not prevent either party from seeking urgent relief or exercising a right before a legal deadline expires.

If you are a consumer, you retain the benefit of any mandatory protections provided by the law of your usual place of residence. Nothing in this section deprives you of those protections or of access to a forum that applicable law makes available to you.

22. Changes to these Terms

We may update these Terms from time to time by posting the revised version and changing the effective date. Changes apply prospectively from the stated effective date. If a change materially affects an existing order or requires additional notice or consent, we will provide it as required by law. Your continued use of the Services after revised Terms take effect constitutes acceptance of those revised Terms.

23. Termination

You may stop using the Services at any time. We may suspend or terminate access if you materially violate these Terms, create risk or potential legal exposure, engage in fraud or abuse, or where suspension is reasonably necessary to protect the Services or other users. Provisions that by their nature should survive termination—including payment obligations, intellectual property provisions, disclaimers, limitations of liability, indemnification, and dispute provisions—will survive.

24. General terms

These Terms, together with the policies and terms expressly incorporated by reference, constitute the entire agreement between you and us concerning the Services and supersede prior discussions or communications on the same subject.

If any provision is found unlawful or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms as part of a merger, acquisition, reorganization, sale of assets, or transfer of the Services, subject to applicable law.
